Acceptance of Terms

By accessing or using the Nativa Alliance Community Action website, creating a campaign, making a donation, or using any campaign-related service, you agree to these Terms of Use and all applicable platform policies.

These Terms should be read together with:

  • Campaign Rules & Guidelines

  • Campaign Disclosure, Fees & Payouts Policy

  • Privacy Policy

  • Any additional payment-processor terms that apply to a transaction

If you do not agree with these terms, do not use the fundraising services.

Purpose of the Platform

Nativa Alliance Community Action provides technology and administrative services that allow eligible individuals, families, organizations, businesses, creators, and community members to publish fundraising campaigns and receive financial support from donors.

Nativa Alliance Community Action is not responsible for guaranteeing the success of any campaign.

Eligibility

Campaign organizers must be legally capable of entering into an agreement.

An organizer may be required to be at least 18 years old to establish a payout account.

Campaigns benefiting minors may require an adult organizer, parent, guardian, or other legally authorized individual to receive or administer funds.

Campaign Organizer Responsibilities

Campaign organizers are responsible for ensuring that all information submitted is accurate and truthful.

By creating a campaign, the organizer represents that:

  • The campaign is being created for a lawful purpose.

  • The organizer has authority to create the campaign.

  • The information presented to donors is truthful and not intentionally misleading.

  • The organizer has permission to use submitted photographs, videos, names, documents, and other materials.

  • Funds will be used consistently with the purpose represented to donors.

  • The organizer will cooperate with reasonable verification requests.

  • Required payout information will be accurate and kept current.

Campaign Review

Nativa Alliance Community Action may review campaigns before or after publication.

We may request identification, supporting documentation, clarification, beneficiary authorization, or other information when reasonably necessary.

Submission of a campaign does not guarantee approval or continued publication.

Prohibited Conduct

Users may not use the platform to:

  • Commit fraud

  • Mislead donors

  • Impersonate another individual

  • Launder money

  • Engage in illegal transactions

  • Circumvent payment-processing rules

  • Harass or threaten others

  • Upload malicious software

  • Attempt unauthorized access to accounts or website systems

  • Use stolen payment information

  • Create campaigns prohibited by our Campaign Rules & Guidelines

Campaign Suspension or Removal

Nativa Alliance Community Action may suspend, restrict, investigate, or remove campaigns when reasonably necessary because of:

  • Suspected fraud

  • False or misleading information

  • Identity concerns

  • Payment disputes

  • Chargebacks

  • Legal requirements

  • Payment-processor restrictions

  • Violation of platform policies

  • Public-safety concerns

  • Other substantial platform risks

A campaign may remain under review while additional information is requested.

Campaign Fees

Nativa Alliance Community Action currently charges a 5% platform and campaign-hosting fee on successful donations received through campaigns hosted on the platform.

Unless otherwise stated, the percentage is calculated using the gross amount of successful campaign donations before third-party processing fees.

Payment-processing fees are separate.

Applicable refunds, reversals, chargebacks, adjustments, or processing charges may affect the final amount available for payout.

The platform may change fees prospectively by updating its published fee disclosures.

Featured Campaigns

Campaign organizers may purchase optional featured or promotional placement.

Featured placement:

  • Does not guarantee donations

  • Does not guarantee campaign success

  • Does not guarantee a particular number of website visitors

  • Does not give a campaign priority regarding fraud or compliance review

Featured campaign fees are separate from ordinary campaign platform and processing fees.

Donations

Donors are responsible for deciding whether to contribute to a campaign.

A contribution does not create an ownership interest, investment interest, partnership, or right to profit unless a separate legally compliant arrangement expressly states otherwise.

The platform does not guarantee that a campaign will achieve its stated goal.

Donor Responsibility

Donors should review campaign information before contributing.

The platform may undertake reasonable review procedures but cannot independently guarantee every factual statement made by every campaign organizer.

Donors should report suspicious campaigns to Nativa Alliance Community Action.

Refunds

Refund requests will be handled according to applicable platform rules, payment-processor requirements, the status of the campaign payout, and applicable law.

Submitting a refund request does not guarantee that a refund will be approved.

Chargebacks and Payment Disputes

Payment disputes and chargebacks may cause campaign proceeds to be delayed, reduced, withheld, or adjusted.

Campaign organizers may be responsible for amounts associated with valid chargebacks, reversals, or related fees to the extent permitted by applicable law and processor agreements.

Payouts

Eligible campaign proceeds will generally be initiated for payout within the period stated in the Campaign Disclosure, Fees & Payouts Policy.

Payouts may be delayed because of:

  • Identity verification

  • Bank verification

  • Processor review

  • Fraud concerns

  • Chargebacks

  • Payment disputes

  • Missing information

  • Legal restrictions

  • Technical issues

  • Financial-institution processing

The date funds appear in a recipient’s bank account is ultimately affected by the recipient’s bank and payment processor.

Payout Verification

Campaign organizers and beneficiaries may be required to complete identity and banking verification before payouts are enabled.

Providing false or incomplete payout information may delay or prevent payment.

Taxes

Campaign organizers and donors are responsible for determining their own tax obligations.

Nativa Alliance Community Action does not provide tax advice.

Campaign proceeds may have different tax consequences depending on the circumstances.

Campaign organizers should retain appropriate records and consult a qualified tax professional when necessary.

Tax-Deductibility of Donations

A donation made through this platform is not automatically tax-deductible.

Unless a particular campaign expressly states that donations are being received by an eligible tax-exempt organization and appropriate documentation is available, donors should not assume that a contribution qualifies as a charitable deduction.

Intellectual Property and Campaign Content

Campaign organizers retain ownership of content they lawfully own.

By submitting campaign material for publication, the organizer grants Nativa Alliance Community Action permission to host, display, reproduce, format, and promote that content for purposes related to operating and promoting the campaign and platform.

The organizer represents that they have permission to provide such materials.

Third-Party Services

The website may use outside services for:

  • Payment processing

  • Banking

  • Identity verification

  • Website hosting

  • Email communications

  • Analytics

  • Security

  • Other technology services

Those services may have separate terms and privacy policies.

No Professional Advice

Information appearing on the fundraising platform is provided for general informational purposes.

Nativa Alliance Community Action does not provide legal, financial, tax, medical, or investment advice through its crowdfunding platform.

No Guarantee

Nativa Alliance Community Action does not guarantee:

  • That a campaign will receive donations

  • That a fundraising goal will be reached

  • That campaign statements are independently verified in every instance

  • That a campaign will remain published indefinitely

  • An exact payout arrival date after funds are transmitted to a financial institution

Limitation of Responsibility

To the extent permitted by applicable law, campaign organizers remain responsible for their campaigns, representations, beneficiaries, and use of campaign proceeds.

Nothing in these Terms excludes rights or remedies that cannot lawfully be waived.

Reporting Fraud or Misconduct

Users who believe a campaign contains fraud, misrepresentation, identity theft, misuse of funds, or other prohibited activity should report the campaign to Nativa Alliance Community Action.

Reports may be investigated and additional verification may be requested.

Changes to These Terms

Nativa Alliance Community Action may update these Terms periodically.

Changes will be posted on the website with an updated effective date.

Material changes affecting existing campaigns will be handled as required by applicable law and applicable agreements.
